NC Helmet Trial Update,

If you were expecting to
find some kind of justice in the NC v. Matt case, so far, there is some, but it is bad rather than good. On
Monday, he showed up as required, determined to bravely proceed in defending himself despite no
attorney.
Matt's attorney from
Virginia was not able to make it to a pre-trial hearing in November. Matt was there, as required. He was told to be
in court on January 4th and that the trial might be then or it might be a date after that. He called his attorney
who told him she could not be there on the 4th and that she would call the District Attorneys' office and try to
arrange an actual date for the trial; in which she would be available. She called the District Attorney's office
and found they were not cooperative. It appears that lawyer is now out of the picture.
Matt showed up as required
on Monday, January 4th, and was required to stay around all day while the court conducted other business.
According to Matt, the judge told him to return to the courtroom at 10am in the
morning.
On Tuesday morning, Matt
showed up at 9am, ready to proceed, as he did the day before. About ten minutes later, an ADA walked into the
courtroom. She found out who he is, looked up his case on their calendar, and told him his case would not be
heard today. She directed him to appear the next morning.
To quote Matt, "...she
didn't know if my case would be called this week or next month. She said that at any time I could still
revert my case back down to the district court and pay the $25 fine. As of now I'm not required to be here
until 11:00 tomorrow."
This was already the third
day Matt has been directed to appear in Superior Court on a certain date. As of tomorrow morning, Matt will
have appeared, as directed by the NC court system, for the fourth time.
What is the prosecutor’s
motto in NC? I suspect it is "Wear them all down and treat them criminally."
